AN ACT MAKING AN APPROPRIATION FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF THE DEPARTMENT OF ARCHIVES AND HISTORY, FOR THE FISCAL YEAR 2000; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. The following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State General Fund not otherwise appropriated, for the purpose of defraying the expenses of the Department of Archives and History for the fiscal year beginning July 1, 1999, and ending June 30, 2000 $ 7,060,492.00.

SECTION 2. The following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the special fund in the State Treasury to the credit of the Department of Archives and History which is comprised of special source funds collected by or otherwise available to the department, for the purpose of defraying the expenses of the department for the fiscal year beginning July 1, 1999, and ending June 30, 2000 $ 2,207,010.00.

SECTION 3. Of the funds appropriated under the provisions of Section 1 and Section 2, not more than the amounts set forth below shall be expended for the respective major objects or purposes of expenditure:

From the funds provided in the budget category "Personal Services: Salaries, Wages and Fringe Benefits," funds may be expended for the following purposes, in compliance with the policies established by the State Personnel Board and any conditions placed on such expenditures:

(a) The components of the Variable Compensation Plan shall be maintained within the constraints of the funds appropriated herein.

(b) Funds are provided to adjust the Variable Compensation Plan, including realignment, to ensure that all full-time employees with at least six (6) months of continuous current service, as of June 30, 1999, receive an increase of One Thousand Five Hundred Dollars ($1,500.00). Funds are provided to adjust critical job classes up to an additional One Thousand Dollars ($1,000.00).

(c) If an employee is currently at or above the end salary for his or her job classification, then the increase shall be built into the employee's base salary. To be eligible for any increase authorized in this section, employees may not have a current performance rating below "meets expectations" as of the effective date of the increase. Employees who subsequently receive a performance rating of "meets expectations" or above during Fiscal Year 2000 shall receive the salary increase effective the date of the rating.

It is the agency's responsibility to make certain that funds required to be appropriated for "Personal Services" for Fiscal Year 2001 do not exceed Fiscal Year 2000 funds appropriated for that purpose unless programs or positions are added to the agency's budget by the Mississippi Legislature.

Any transfers or escalations shall be made in accordance with the terms, conditions and procedures established by law.

No general funds authorized to be expended herein shall be used to replace federal funds and/or other special funds which are being used for salaries authorized under the provisions of this act and which are withdrawn and no longer available.

SECTION 4. The Mississippi Department of Archives and History is hereby authorized to accept and expend any grant, donation or contribution from any individual, public or private organization, or government entity for purposes of defraying the operational costs of the department. Such grants, donations or contributions shall be received and expended under the rules and regulations of the Department of Finance and Administration in a manner consistent with the escalation of federal funds.

SECTION 5. It is the intent of the Legislature that the Mississippi Department of Archives and History shall charge the maximum amount allowable for services rendered, consistent with the cost of providing such services. The funds derived from these charges shall be deposited into a special fund account in the State Treasury to the credit of the Mississippi Department of Archives and History.

SECTION 6. It is the intent of the Legislature that no part of the funds herein appropriated shall be required to be used for the payment of rent for the museum and public space in the State Historical Museum, Old Capitol Restoration.

SECTION 7. In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any funds from the Local Government Records Fund in the State Treasury to defray the cost of such program for the fiscal year beginning July 1, 1999, and ending June 30, 2000 $ 259,734.00.

With the funds appropriated in this section, the following positions are authorized:

SECTION 8. The following sum, or so much thereof as may be necessary, is hereby reappropriated out of any money in the State General Fund not otherwise appropriated, to the Department of Archives and History for the purpose of reauthorizing the expenditure of State General Funds, as authorized in House Bill No. 1792, Regular Session of 1997, and House Bill No. 1765, Regular Session of 1998, for the fiscal year beginning July 1, 1999, and ending June 30, 2000 $ 50,000.00.

This reappropriation is made for the purpose of reauthorizing the expenditure of State General Funds to design, construct and erect a monument at Gettysburg to memorialize the Eleventh Mississippi Regiment.

Notwithstanding the amount reappropriated under the provisions of this section, in no event shall the amount expended exceed the unexpended balance as of June 30, 1999.

SECTION 9. Funds are provided in this act for the reallocation of the following positions not to exceed One Hundred Forty-one Thousand Eight Hundred Seven Dollars ($141,807.00):

SECTION 11. Of the funds provided in Section 2, Six Hundred Thousand Dollars ($600,000.00) is provided to the Department of Archives and History from the Mississippi Landmark Grant Fund as created in House Bill No. 1082, Regular Session of 1999, to help support the preservation of Mississippi Landmark Properties.

SECTION 12. Of the funds appropriated in Section 1 and allocated in Section 3, Fifty Thousand Dollars ($50,000.00) is provided to restore the historic Beulah Cemetery, a National Register of Historic Places property in Vicksburg, Mississippi. The Department of Archives and History may enter into cooperative agreements with the City of Vicksburg and Tabernacle No. 19, Independent Order of Brothers and Sisters of Love and Charity to implement the restoration of the Beulah Cemetery.

SECTION 13. Of the funds appropriated herein, Five Thousand Dollars ($5,000.00) is provided for the portraits of Governor Allain and Governor Fordice.

SECTION 14. Of the funds appropriated in Section 1 and allocated in Section 3, One Million Dollars ($1,000,000.00) is provided for enhancement grants authorized by the Transportation Equity Act for the 21st Century (TEA-21), administered by the Mississippi Department of Transportation (MDOT).

SECTION 15. The money herein appropriated shall be paid by the State Treasurer out of any money in the State Treasury to the credit of the proper fund or funds as set forth in this act, upon warrants issued by the State Fiscal Officer; and the State Fiscal Officer shall issue his warrants upon requisitions signed by the proper person, officer or officers, in the manner provided by law.

SECTION 16. This act shall take effect and be in force from and after July 1, 1999.
